The plaintiffs in the 5th district Democratic town committee law suit have won....sort of.
Judge Susan Peck upheld their claim that claim that their opponents - known as the Abe Giles slate - should be taken off the ballot for Tuesday's Democratic primary.
But Peck declined to terminate a stay of her decision filed by city attorney John Rose so the election will go forward with everybody on the ballot today.
Rose also is expected to file an appeal to overturn Peck's decision. The appeal will be moot if the plaintiff's slate wins at the polls and the state Supreme Court sides with Peck. The point will also be moot if the Giles slate wins and the court overturns Peck.
Got that straight? Yeah, neither did I till attorney William Sweeny explained it to me very patiently about four times.
